Check Point Research conducted research that revealed a sudden increase in the availability of deepfake services. Deepfake technology allows for the creation of seemingly realistic, but in reality fake images and videos that pose a significant threat to privacy and security.

Disinformation and fake news on the global web

The European Union and its unit responsible for GDPR have undertaken an analysis of the significant increase in disinformation and the negative impact of so-called fake news on the global web. According to the European Commission, both the processing of personal data by the media and by specific journalists fall within the scope of GDPR. It was noted that the media are obliged to comply with personal data protection regulations in order to limit the spread of so-called fake news.

The right to be forgotten

The European Commission indicated the “Right to be forgotten” enabling individuals to request the deletion of their personal data, especially in the case of data processing contrary to the letter of the law. This part of the opinion was included in the formal response to Robert Szustkowski’s appeal to extend the Right to be forgotten also to the media as data controllers.

CJEU and Google

In 2023, under the CJEU judgment, Google was ordered to remove from its search lists any reputation-damaging, false information about persons on the board of a German company. The CJEU ruled that entrepreneurs have the right to protect their reputation.

Cases of spreading false content in Poland

There is also no shortage of examples in Poland of situations in which false content was spread on the Internet. They concerned, among others, businessman Rafał Brzoska, footballer Robert Lewandowski, and actress, presenter, and model Anna Mucha. Another case of this type was the attack on the Polish Press Agency’s news service. It was carried out by hackers associated with Russia.

Increased risk of deepfakes

Check Point specialists confirm that both the number and the threat caused by deepfakes in Poland have increased by 100% since January this year. This is a technological threat and a challenge to the democratic system of each country belonging to the European Union.

Recommendations of the European Commission for Poland

The European Commission has presented recommendations for Poland, indicating that in the event of personal data being made public, it is necessary for the administrator of personal data to take decisive steps to inform the administrators processing the said personal data about the request to delete links to both the aforementioned information and their copies, etc.
