Robert Szustkowski, an entrepreneur and philanthropist, has sued Ringier Axel Springer Polska (RASP), seeking over PLN 54 million in damages for failure to comply with the 2020 Settlement Agreement.

Defamatory publications and their consequences

The 2020 settlement obligated RASP to permanently remove publications defamatory of Szustkowski from 2016 to 2018. These articles are still available, which has led to personal and professional harm for Szustkowski, including health problems, closure of the charity, and social exclusion.

Legal context

In connection with RASP’s refusal to remove the articles, Szustkowski decided to sue. The case is being handled by attorney Elżbieta Kosińska-Kozak from Dubois & Partners.

Scale of the claim

The lawsuit may become one of the largest financial claims in Poland in the field of violations of personal rights. Defamatory media materials published over the years have perpetuated a negative image of Szustkowski as a Russian agent of influence, which is particularly damaging in the context of the ongoing war in Ukraine.

Consequences for personal and professional life

As a result of the accusations, Szustkowski had to withdraw his investments from Poland, close his charitable foundation, and face health problems and social ostracism. Szustkowski’s son is also experiencing the consequences of false accusations.

Purpose of the 2020 settlement

The 2020 settlement was intended to repair the damage caused by the defamation and prevent further violations. Szustkowski notes that if RASP had properly implemented the settlement, his reputation would not have been ruined.
